Training Session Agreement
This Training Session Agreement (the "Agreement") is entered into between Montgomery Hassell Inc. (the "Provider") and the participant or purchasing party (the "Participant") who enrolls in the training session(s) (the "Training").
1. Payment Terms
1.1. Full payment for the Training is required at the time of registration. Payment must be made through the methods specified by the Provider.
1.2. By completing payment, the Participant agrees to the terms outlined in this Agreement.
2. No Refund Policy
2.1. Once the payment is processed, all sales are final, and no refunds will be issued for any reason, including but not limited to:
Failure to attend the Training.
Scheduling conflicts.
Change in Participant's circumstances or availability.
2.2. The Participant acknowledges and agrees to this no-refund policy upon registration.
3. Substitution Policy
3.1. If the registered Participant is unable to attend the Training, the Participant may designate a substitute to attend in their place, subject to the following conditions:
The Participant must notify the Provider in writing up to the session date.
No additional fees will be charged for approved substitutions.
The original Participant remains responsible for ensuring the substitute is aware of all relevant details related to the Training.
3.2. The Provider reserves the right to deny a substitution request if the substitute does not meet the qualifications required for the Training.
4. Cancellations or Rescheduling by the Provider
4.1. The Provider reserves the right to cancel or reschedule the Training in case of unforeseen circumstances, including but not limited to:
Instructor unavailability.
Insufficient enrollment.
Force majeure events (e.g., natural disasters, pandemics).
4.2. In the event of cancellation or rescheduling by the Provider, the Participant will be offered an opportunity to transfer to a future session or receive a full refund.
5. Intellectual Property
5.1. All training materials, presentations, and content provided during the Training are the exclusive property of the Provider and are protected by copyright laws.
5.2. The Participant agrees not to distribute, reproduce, or share any training materials without the prior written consent of the Provider.
6. Limitation of Liability
6.1. The Provider shall not be held liable for any indirect, incidental, or consequential damages that may arise from the Participant's participation in the Training or from any cancellation or rescheduling of the Training.
6.2. The Provider's total liability for any claims related to this Agreement shall not exceed the amount paid by the Participant for the Training.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia without regard to its conflict of laws principles.
8. Acceptance of Terms
By registering and paying for the Training, the Participant acknowledges and agrees to all the terms and conditions outlined in this Agreement.
